These terms & conditions shall apply to all contracts, written or verbal, for the hire/sale of goods from MAV Services Ltd T/A Multicord.

Multicord shall use all reasonable care to provide equipment in good working order. However, Multicord shall not be held liable for any consequential loss to the hirer, including any expense, liability, loss, injury, damage, claim, or proceeding whatsoever caused by or arising from any malfunction, late delivery, non delivery, unsuitability or any breakdown or stoppage of the same.

Equipment is supplied on condition that the hirer is aware of its uses and limitations, and Multicord shall not be responsible for the equipments suitability for any particular purpose. The hirer shall indemnify Multicord against any claims by third parties arising from the use, misuse or non-use of the equipment.

The Hirer shall pay Multicord the appropriate rate as shown on Multicord’s current Hire Price List.

Any equipment not returned at the time agreed when placing the order will be charged at the daily rate and will continue to be charged until the equipment is back in the possession of Multicord. Additional hire and collection charges will apply. The duration of the hire is deemed to be from the time the goods leave Multicord’s premises until the time the goods are returned to Multicord’s premises.

The prices quoted do not include VAT, delivery, installation, operation or collection, and a charge for any or all of these items will be payable at the prevailing rate.

Unless the hirer has previously negotiated credit facilities with Multicord, payment in full must be made before the hirer takes possession of the goods. In addition, Multicord may at its sole discretion request and be paid a deposit up to the value of the equipment, this deposit to be returned upon the return of the equipment in an undamaged condition.

If credit facilities have been agreed with Multicord, payment is to be made strictly within 30 days of date of invoice. No statements are issued. If payment is not received within these payment terms, Multicord may at its sole discretion withdraw credit facilities and reclaim any expenses incurred with relation to non payment or late payments. All goods remain the property of Multicord until payment has been made in full. If payment is not received within the above said payment terms, Multicord shall be entitled to enter upon the customers premises and repossess the goods and the customer shall be liable to compensate Multicord for any cost of such repossession.

If payment is not received within our payment terms we reserve our right to claim statutory interest at 8% above the Bank of England reference rate in force from the date the debt became overdue and at any subsequent rate where the reference rate changes and the debt remains unpaid in accordance with the Late Payment of Commercial Debt (Interest) Act 1998 as amended and supplemented by the Late Payment of Commercial Debts Regulations 2002.

The hirer is responsible for the equipment for the duration of the hire, and will recompense Multicord for any loss or damage; all repairs or replacements will be charged for as will any shortages. No loss or damage shall affect or impair the obligations of the hirer, in particular with regard to payment. The hirer will not make alterations to the equipment. The hirer will take out adequate all-risks insurance. If requested in writing by the Hirer, Multicord will arrange appropriate insurance, and charge the premium to the Hirer.

In case of the equipment being dispatched before notice of cancellation is received in writing, then one full days hire fees plus delivery, installation and collection charges will apply.

In the event of equipment failing to operate in accordance with published specifications, the hirer must notify Multicord immediately by email or phone, otherwise a credit against the hire charge will not be issued.

All orders must be confirmed in writing and accompanied by an official order number.

Multicord reserves the right to terminate for any reason whatsoever, without explanation, any hire contract with immediate effect and repossess any and all hired equipment.

No variation or addition to these conditions of business shall be binding on Multicord unless made in writing and signed by a partner of Multicord.
